The following terms and conditions are valid for Veiana.com, explain how we supply any of the goods shown on our online shop and regulate the contract between Veiana KIG (“seller/us”) and the client (“buyer/you”). Please read the following terms and conditions carefully before ordering. By ordering any of our products you agree to the terms and conditions. The online shop is led by Veiana KIG represented by Diana Santos and Simon Scherbaum. We keep the right to adjust the terms and conditions at any time. The version of them at the point of your order will be relevant.

Offering

The presentation of the products on www.veiana.com does not represent a legally binding offer, but rather an invitation to the customer to place a binding order. The offer is valid as long as the product can be found in the online shop and is in stock. The offerings are aimed at customers with a place of residence or company headquarters in Switzerland and Liechtenstein.

By clicking the order button, the customer places a binding order for the products listed on the order page. Afterwards the seller sends the customer an automatic acknowledgment of receipt by e-mail, in which the buyers order is listed again. The automatic acknowledgment of receipt only documents that the buyers order has been received by the seller and does not constitute acceptance of the application. The purchase contract is only concluded if the seller sends the ordered product to the customer within five days, hands it over or confirms the customer explicitly within two days with a second e-mail that the contract is settled.

Return policy

The buyer has the right to withdraw from this contract within 10 days of receipt of the goods in accordance with the provisions of this section without giving any reason. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (post, letter or e-mail). If you revoke this contract, we have to repay all payments that we have received from you immediately and at the latest within 10 days from the day on which we received the notification of your revocation of this contract. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. The buyer must bear the costs of a return shipment of CHF 80.

If the product is of poor quality or you did not order it, the seller will be happy to take back the product and reimburse the purchase price, return transport costs and the original shipping costs, regardless of your right of withdrawal and warranty claims. In this case, however, the products will not be taken back if they show signs of use.

Prices and cost of shipments

The prices stated on the product page include the statutory VAT and other price components and are in Swiss francs (CHF). The seller is free to set prices and change them at any time. When ordering, the price published on the website is decisive. If prices have been published in error, the seller reserves the right to inform the buyer before shipping in order to agree on a price correction or to cancel the order. If the costs of shipment are not included in the price the exact shipping costs are displayed to the customer in the ordering process.

Delivery terms

Deliveries are only made to addresses within Switzerland and Liechtenstein.  Items that are in stock will be handed over to your delivery partner within 4-6 working days and usually take two weeks to arrive at your destination. In rare cases this can take up to ten weeks. We will inform you after your order about the approximately time of delivery.

If the buyer does not accept the goods delivered by the supplier within the agreed or specified delivery times, the seller can withdraw from the contract, cancel the order and charge the customer a processing fee of 15%.

Terms of payment

We accept bank transfer, credit card and cash. The invoice amount is to be transferred to the seller’s account within 20 days. When paying by credit card, the customer’s account will be debited when the order is placed, unless otherwise agreed. If the goods are picked up, the amount is due upon receipt of the goods. Offsetting against counterclaims of the customer that are not recognized or have not been legally established is excluded.

Warranty and inspection obligation

The seller provides a guarantee for the goods in accordance with Art. 197 of the ”Schweizerischen Obligationenrechts” for two years after delivery of the them. The seller does not guarantee that the delivered products will not deviate from the products shown in terms of colour, structure, materials and processing of the goods (images may differ from the original product) or in relation to incorrect information in item descriptions, details and specifications. The warranty also does not apply to defects in purchased products that occur as a result of normal use and tear or improper handling or damage by the customer or third parties, or to defects that are due to external influences (force majeure, etc.). The warranty claim expires if the customer processes or changes the goods.

The delivered or collected products are to be checked by the buyer for completeness, correctness and delivery damage immediately after acceptance. If there is a defect, this must be reported to the seller within 5 working days and the product must not be put into operation.

Liability

Unless explicitly mentioned in these terms and conditions, the seller excludes any liability for any direct and indirect damage within the scope of what is legally permissible.

The seller undertakes to comply with data protection regulations when processing customer data. Applicable Law and Jurisdiction

The relationship between Veiana KIG and the customer is exclusively subject to Swiss law. Place of jurisdiction is Zurich.
